Establishment of the Presidential Commission on the Supreme Court of the United States 

Abstract

This EO authorizes the formation of the Presidential Commission on the Supreme Court of the United States. The members of the commission are to investigate ways to reform the Supreme Court.

Summary

Establishes a Commission of up to 36 members tasked with providing a report on the Supreme Court within 180 days of their first public meeting. The report will explore the current debate on the role of the Supreme Court and the process of appointing justices. It will also include investigations of historical and contemporary proposals to reform the court. The members will not receive compensation for their work, but can receive travel expenses, including per diem. The commission will terminate 30 days after submitting the report to the President.


Funding and administrative support will be provided by the Office of Administration within the Executive Office of the President. The General Services Administration may provide other administrative services, facilities, staff, and equipment.

PRO & CON

PRO: The role and make-up of the Supreme Court has come under intense scrutiny over the past few years. The commission will provide the President with an up-to-date analysis of the arguments for and against changing the court structure and function.


CON: The current administration views the Supreme Court as a hindrance to instituting its policies. The unstated purpose of the commission is to produce a biased report that will form the basis of a court-packing proposal.
